Terms of Service
The short version
- We do not store a copy of your vault or its encryption key. So we cannot restore it for you. Keep your encrypted Apple backup on.
- Your notes are yours. You give us only the narrow right to process the excerpts the AI features need. We do not use your notes or AI inputs to train models.
- lumollo helps you remember; it does not advise you. Nothing it writes is medical, legal, financial or professional advice.
- The AI gets things wrong. Read what it drafts before you act on it or send it.
- You are responsible for what you write about other people, and for having a good reason to write it.
- You must be 16 or older.
- Deleting the app does not cancel a subscription — that is done through Apple (§10).
- Disputes go to individual arbitration, not court — and you can opt out within 30 days if you would rather they did not.
1. Who these terms are between
These terms are between you and the provider of lumollo (“lumollo”, “we”, “us”), which is based in the United States. They cover the lumollo iOS app, this website, and the service behind them.
By installing or using lumollo you accept these terms. If you do not accept them, do not use it. The privacy policy forms part of these terms and explains what happens to your data.
2. What lumollo is
lumollo is a private notebook for your relationships. You tell it small things you learn about people you know; it organises them and hands them back when they are useful — what to ask about, what you promised, what is coming up.
It is a memory aid, not an adviser. It does not provide medical, psychological, legal, financial or other professional advice, and nothing it produces should be treated as such. If a note touches your health or someone else’s, lumollo is still just remembering it for you.
3. Your account, and your age
- You must be 16 or older to use lumollo, matching §10 of the privacy policy. By using it you confirm that you are. If we learn that an account belongs to someone younger we will close it and delete what we hold.
- An account is optional for using the app on one device. It exists so the AI features and your subscription can work, and so we can reach you about the service. Your settings are not stored on our side — they live in the vault on your phone, and they travel the same way it does (§4).
- Give an email address that is yours and that works. Keep your sign-in details to yourself; you are responsible for what happens under your account.
- Tell us at support@lumollo.ai if you think someone else has got into it.
4. We do not store a copy of your vault or its encryption key
This is the most practical thing on this page, so it has its own section.
Your notes are encrypted on your device, and the key is created there and stays there. We store neither. There is no vault of ours, no sync, no mirror — nothing on our side to hand back.
What we do hold is limited account and subscription data, and the short masked excerpts that pass through our server on their way to the AI provider and back. What that means exactly — what is sent, what is kept, and for how long — is set out in the privacy policy, and nothing in this section is meant to contradict it.
The consequence of the design is worth stating plainly:
- If you lose your phone and have no backup, the vault is gone. We cannot recover it, reissue it, or reconstruct it, because there is nothing on our side to reconstruct it from.
- Your vault and its key travel in your encrypted Apple backup — iCloud Backup, or an encrypted computer backup. Restoring your iPhone from one brings both with it. An unencrypted computer backup does not, because it carries no keychain items at all.
- The key is not put into iCloud Keychain, so it does not appear on your other devices. It rides the backup and nothing else.
- Keeping a working backup is yours to do. We recommend leaving iCloud Backup on.
5. Your notes are yours
You own what you write. These terms transfer nothing. We claim no ownership of your notes, your imported chats, or anything the app derives from them.
To make the AI features work we need one narrow permission, and only that:
- You give us a limited, non-exclusive, revocable licence to transmit, host and process the specific excerpts your phone selects, and only for as long as it takes to return the result to you.
- It covers nothing else. Not your library, not publishing, not analysis for our own purposes, not sharing with anyone beyond the processors named in §3.4 of the privacy policy.
- It ends when the processing does. We keep no copy of the excerpt or the result.
- It ends entirely when you stop using the AI features or delete your account.
We do not use your notes, your excerpts or the AI’s answers to train models — ours or anyone else’s — and our AI provider is contractually bound not to train on them either. This matters more here than in most apps, because notes about the people in your life can be sensitive by nature.
6. What the AI does, and what you should not assume
lumollo sends a small, masked excerpt of a note to an AI provider so it can be understood — the detail is in §3 of the privacy policy.
- AI output can be wrong, incomplete, or oddly worded. It can misattribute a fact, misread a date, or invent a detail that was never in your note.
- Messages are drafts. lumollo never sends anything to anyone on your behalf. Read a draft before you send it.
- Do not rely on lumollo for anything with a real deadline or a real consequence without checking it yourself.
- The AI features depend on a third-party provider. They may be slow, briefly unavailable, or change.
7. Writing about other people
lumollo is a notebook about people who are not you, so this matters more here than in most apps.
- You decide what to write. You are responsible for it — for having a legitimate reason to keep it, and for handling it decently.
- Do not use lumollo to build files on people for harassment, stalking, discrimination, or any purpose that would harm them.
- Take particular care with anything about someone’s health, beliefs, sex life, politics or ethnicity, and with notes about children.
- If someone asks what you hold about them, that request is yours to answer — the notes are on your phone, not on our server. See §5.3 of the privacy policy.
8. What you may not do
- Break the law with it, or use it to harm, harass or deceive someone.
- Try to break into the service, other people’s accounts, or the AI provider behind it.
- Send deliberately abusive volumes of requests, or work around the limits that keep the service running for everyone.
- Upload malicious code, or content you have no right to hold.
9. Your licence to use lumollo, and what stays ours
We grant you a personal, non-exclusive, non-transferable, revocable licence to use one copy of the lumollo app on Apple devices you own or control, for your own non-commercial use, in line with the App Store’s usage rules.
Everything else about lumollo stays ours — the software, the design, the interface, the name and the marks. Nothing in these terms gives you rights in any of it. So, except where the law expressly says otherwise, please do not copy, modify, distribute, sell or lease any part of the app; reverse engineer or attempt to extract its source; or use our name or marks without written permission.
10. Paying for it, and cancelling
If lumollo has a paid plan, the price, the billing period and what it includes are shown in the app before you buy. Purchases are handled by Apple through your App Store account, on Apple’s terms.
- Deleting the app does not cancel a subscription. This catches people out, so it is worth being blunt: an App Store subscription keeps renewing until you cancel it, whether or not the app is still installed.
- Cancel through Apple, not through us: Settings → your name → Subscriptions. We cannot cancel it for you.
- Cancelling stops the next renewal. It is not a refund, and access normally continues to the end of the period you have already paid for.
- Refunds are Apple’s to give, under their policy. If something has gone wrong, write to us anyway — we would rather know.
We may change prices for future billing periods. We will tell you before a change affects you, and you can cancel.
11. Ending it, and what deletion actually deletes
- You can leave at any time. Delete your account in the app, or simply delete the app.
- Deleting the app removes the vault from that device. It does not touch your account, and it does not cancel a subscription (§10).
- Deleting your account removes what we hold on our side: your email address, the one-way scrambled form of your password, your account number, your sessions and any outstanding codes. It is a real deletion, not a flag. It does not delete the vault on your phone — we cannot reach that; delete the app or use the in-app reset for that.
- Afterwards we keep nothing about you, other than anything the law obliges us to retain, and only for as long as it obliges us. Usage and cost totals are tied to nothing about you and are not personal data. A signup that is never confirmed is deleted automatically within nine days. The full picture is in §6 of the privacy policy.
- Us: we may suspend or close an account that breaks §8, that is being used to harm someone, or that we are required to act on. Where we reasonably can, we will tell you first and give you a chance to respond.
12. Changes to the service
lumollo is actively being built. Features will be added, changed and sometimes removed. If a change affects what leaves your phone, what we store, or who handles it, we tell you in the app before it takes effect — the same promise as §12 of the privacy policy.
13. Other terms that also apply
These terms do not replace anyone else’s, and where they overlap, the other party’s terms govern their part of it:
- Apple. Your use of the app is also subject to the App Store terms and Apple’s standard Licensed Application End User Licence Agreement. Where those conflict with this page, they win. Apple is not a party to these terms, has no obligation to support the app, and is a third-party beneficiary entitled to enforce them against you.
- Apple and Google sign-in. If you sign in with either, their own terms and privacy policies apply to that.
- The AI provider. We are their customer, not you, and we pass no obligations to you — but their acceptable-use rules shape what the service can do, which is part of why §8 exists.
14. No warranty
lumollo is provided as is. We do not promise it will be uninterrupted, error-free, or that what the AI produces will be accurate or suitable for any particular purpose. To the extent the law allows, we exclude implied warranties.
Nothing here takes away rights you have as a consumer that cannot be excluded by agreement.
15. Liability
To the extent the law allows:
- We are not liable for loss of your vault or your notes. See §4 — we store no copy, and keeping a backup is yours to do.
- We are not liable for indirect or consequential loss, lost profits, or lost opportunity.
- Where we are liable, our total liability is limited to what you paid us in the twelve months before the claim, or US$100 if you paid nothing.
- We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.
16. If these terms change
We update the date at the top and publish the new version here. For a change that materially affects you, we will tell you in the app, and by email once your address is confirmed.
Material changes apply from the date they take effect, and not retroactively — anything that already happened is judged by the terms that were in force at the time. If you do not agree to a change, stop using lumollo and delete your account; that is your remedy, and you keep the rights you already had in respect of what came before.
17. Disputes: talk to us first, then arbitration
Please email us before anything formal. Most problems are a misunderstanding or a bug, and support@lumollo.ai is faster than any process on this page. If we have not sorted it out within 30 days of you raising it, the rest of this section applies.
You and we agree to settle disputes by individual arbitration rather than in court, under the Consumer Arbitration Rules of the American Arbitration Association. Arbitration is less formal than a lawsuit: an arbitrator decides, and the decision can be entered as a judgment. It may be held by phone or on documents alone, or in person in the county where you live. Where the AAA rules make us responsible for the filing and arbitrator fees, we will pay them.
Individually, not as a class. Neither of us may bring a claim as a plaintiff or class member in a class, consolidated or representative action, and the arbitrator may not combine one person’s claims with another’s. If this paragraph is held unenforceable for a particular claim, that claim — and only that claim — goes to court, and the rest of this section still stands.
Both of us give up the right to a jury trial for anything covered by this section.
Two things stay out of arbitration: either of us may bring a claim in small claims court if it qualifies, and either of us may ask a court for an injunction to stop misuse of intellectual property.
You can opt out of arbitration, and it costs you nothing. Email support@lumollo.ai with the subject Arbitration opt-out within 30 days of first accepting these terms. Say who you are and that you are opting out; that is the whole requirement. Opting out changes nothing else about your account and we will not treat you differently for it. If you opt out, disputes go to the courts in §18 instead.
18. Law
These terms are governed by the law of the State of Delaware, without regard to its conflict-of-laws rules, and by the Federal Arbitration Act for §17. For anything not going to arbitration, the state and federal courts in Delaware have jurisdiction.
If you are a consumer in the UK or the EEA, none of that takes away the protection of the mandatory law where you live, and you may bring proceedings in your local courts.
19. Odds and ends
- If a clause turns out to be unenforceable, the rest stays in force.
- Not enforcing something once does not mean giving it up.
- These terms and the privacy policy are the whole agreement between us about lumollo.
- You may not transfer your rights under these terms; we may transfer ours if the business does, without reducing your rights.
20. Contact
